Two recent House of Lords judgements have clarified the interpretation of the priority need category for homeless 16/17 year olds and highlighted the primacy of the Children Act in responding to young single homelessness.
Seminar context:
Does every child matter and can the paramouncy principle of the best interests of the child be satisfied within the context of performance indicators and potentially shrinking resources?
Seminar contains:
• Research into causal factors, young peoples’ perspectives on the service that they receive and research into temporary accommodation
• Philosophy and key principles underpinning the Children Act
• The key sections of the Children Act and relevant guidance (currently subject to review)
• The problems in many areas of getting Children Act assessments and triggering Children’s Services engagement: Unintended consequences of the Children Leaving Care Act?
• Structural duties to co-operate inherent in the Children Act and Part VII and the expectations of guidance
• Judicial interpretation of the Children Act illustrated by Unaccompanied Asylum Seekers and homeless families
• Historical case law on evasion of duties and obtaining assessments
The seminar will be illustrated by practical exercises and participants’ evidence of local good practice. Delegates will be actively encouraged to debate the key issues.
